Terms of Service.

These terms govern your relationship with Hostander when you order, use or pay for any of our managed hosting services. We have done our best to keep them readable.

1. Who we are

Hostander is a managed hosting brand operated by an EU-incorporated company headquartered in Tallinn, Estonia. References to "Hostander", "we", "us" or "our" mean that company. References to "you" or "Customer" mean the legal entity or natural person who orders our services.

2. Services we provide

We provide managed hosting services, including managed VPS, managed dedicated servers and managed colocation. Each service is delivered from one of the Tier III data centers we host in (currently Tallinn and Amsterdam) and is operated by Hostander engineers on hardware we own. The exact specification, location, support scope and price for your service are defined in your order and any service-level agreement we sign with you.

3. Account and orders

To order a service you must create an account, provide accurate information and accept these terms. You are responsible for keeping your login credentials confidential and for all activity under your account. Orders take effect once we accept them and provision your service.

4. Fees, billing and renewal

Services are billed in advance, monthly, quarterly or annually depending on the term you select. Invoices are issued in EUR unless agreed otherwise. Recurring services renew automatically for the same term unless you cancel before the renewal date. Late payment may result in service suspension after written notice.

5. Acceptable use

Your use of our services must comply with our Acceptable Use Policy and our Fair Use Policy. We reserve the right to suspend or terminate services that violate these policies, applicable law, or that endanger the stability, security or reputation of our network.

6. Service levels and credits

Our service-level commitments and the credits available if we miss them are defined in our Service Level Agreement. Service credits are your sole and exclusive remedy for service unavailability covered by the SLA.

7. Customer data and confidentiality

Your data remains yours. We process personal data on your behalf in accordance with our Privacy Policy and our Data Processing Agreement, which forms part of these terms when you process personal data using our services. We treat all customer information as confidential.

8. Intellectual property

You retain all rights to the data, software and content you place on our infrastructure. We retain all rights to our platform, tooling, documentation and brand. Nothing in these terms transfers ownership of intellectual property between us.

9. Liability

To the maximum extent permitted by law, neither party is liable to the other for indirect or consequential losses, lost profits, lost revenue or loss of data. Our total aggregate liability for any claim relating to the services is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. Nothing in this section limits liability that cannot be excluded under applicable law.

10. Term and termination

Either party may terminate a service at the end of its current billing term by giving written notice. We may terminate immediately for material breach (including non-payment after notice or serious AUP violations). On termination we will give you a reasonable window to retrieve your data before infrastructure is wiped.

11. Changes to these terms

We may update these terms to reflect changes in our services or applicable law. Material changes will be communicated by email at least 30 days in advance. Continued use of the services after the effective date constitutes acceptance of the updated terms.

12. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Estonia. Disputes are subject to the exclusive jurisdiction of the courts of Estonia, without prejudice to mandatory consumer protection rights you may have in your country of residence within the EU.
